Aduc, an Italian Consumers association, has served on Microsoft Italia (the local branch of Microsoft Corp) a class action complaining that the company consistently refuses to reimburse users the price of ubiquitous windows licenses, bundled with OEM (Original Equipement Manufacturers) computers. I am part of a much larger legal team that has produced it and I can briefly illustrate what it is about.
Italy has adopted a regulation (Art. 140 bis of the Italian Consumers Code) that allows consumers individually (not consumers associations, which is strange) to file class actions, through ordinary proceedings, open to be joined at a later time. A class action is a case which is arguably identical to a class of users and which is likely to protect the interest of this class. Unfortunately, the Italian version has been adopted with very odd provisions that limit the effectiveness of it, as one can read in this document by Aduc (in Italian).
Problem: have a set of ODT files (tech transfer contracts) that I need to update, but not just now, because they contain a stale proprietary notice that needs to be changed. Perhaps I will never update them all, but only a few. So I prefer to put a notice in each of them to say "hey, you haven't updated notice X yet". They are hundreds in tens of folders and subfolders.
Solution: Luckily they are ODF files, ODF is a zipped XML, a PERL module exists to do incredible tricks.
I have then made this basic script, just tweaking the example provided:

La Free Software Foundation Europe è il facilitatore di un gruppo di legali che include centinaia di esperti provenienti dalla professione, dall'industria e dalle università in tutto il mondo. Uno dei gruppi di interesse specifico (SIG) si è dedicato per circa un anno a produrre un documento che spiega come combinare tra loro differenti applicazioni e librerie software sotto differenti licenze e come queste possano essere o non essere considerate un prodotto derivato di ciascuna altra.
Il risultato è quello che chiamiamo il "linking document". Potrà non essere perfetto, ma è una valida piattaforma di discussione intorno una materia che fa venire più di un mal di testa a numerosi attori nel campo. Per trovare una discussione simile, ancorché controversa e limitata alle sole licenze GNU, si deve far riferimento alle FAQ della FSF.
L'International Free and Open Source Software Law Review, (IFOSS L. Rev.) Volume 2, Issue 1, è uscito con un mio articolo circa il recente caso in cui la Corte Costituzionale ha ritenuto -- tra altre cose -- legittimo costituzionalmente accordare preferenza nelle gare di appalto a programmi sotto condizioni di Software Libero.
